Parents Seek to Invalidate California’s Strict New Vaccination Requirements

Jul 7, 2016 | Legal Developments and News

On the day California’s stricter vaccination requirements became effective, a group of parents in San Diego filed a lawsuit in federal court seeking to invalidate them (Senate Bill 277).  SB277 became effective last Friday, and among other amendments, eliminated the previously available personal belief exemption from vaccination requirements for public school attendance. The lawsuit argues the elimination of personal and religious exemptions from vaccination requirements violates students’ and parents’ rights under the state and federal constitutions and a variety of state and federal statutes. SB277 was passed by the Legislature and signed by the Governor last year following a measles outbreak in California schools.
