Is Your UCP Policy Up to Date?

Apr 21, 2016 | Legal Developments and News

Many recent legislative changes have expanded or clarified the scope of issues that school districts must process through their Uniform Complaint Procedures (UCP).  Currently, written complaints ranging from unlawful discrimination, harassment, intimidation, bullying, foster youth services, special education, pupil fees, the provision of physical education minutes, to Local Control Funding Formula, and Local Control Accountability Plans, among others, must be processed pursuant to the UCP. Given the breadth of issues covered by the UCP, it is important your school district’s policy is up-to-date to ensure the proper and timely handling of complaints, particularly since processing them often requires involvement of several departments. Absent compliance with the UCP for complaints under its expanded purview, those complaints could be eligible for direct state intervention.

If you have questions about the recent changes to the UCP or about your school district’s policy, please contact a DWK attorney.
